By using this site you acknowledge that you have read the Terms of Use and Service Agreement (the "Agreement") and the disclaimers contained in this site, and accept and agree to comply with and be bound by the following Agreement, which may change at any time.

The content, text, organization, graphics, images, design, compilation, magnetic translation, digital conversion and other matters related to WriteContent are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights, and the copying, redistribution, use or publication by a User of any such content or any part of the service is prohibited. All written material used on this site is the property of WriteContent or its authors or contributors and protected by U.S. and international copyright laws. The material on this site may be for personal, non-commercial use. The User does not acquire ownership rights to any content or document obtained by or through the service.

B. Disclaimer of Liability

The service and content from or through this site are provided by WriteContent "as-is" or "as available," and all warranties, express or implied, are disclaimed including but not limited to the disclaimer of any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The information herein may contain bugs, errors, problems or other limitations. The Qwner of this site assumes no liability or responsibility for any errors or omissions in the content contained on this site.

User agrees to indemnify, defend, and hold WriteContent and its affiliates, licensors, partners, content and service providers, participating publishers, authors, freelancers, writers and any suppliers harmless from any liability, loss, claim and expense, including attorney's fees and expenses, related to a User's violation of this Agreement or use of WriteContent.

WriteContent also assumes no responsibility, and shall not be liable for any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the site or your downloading of any electronic files or materials from the site.

C. Hyperlink Disclaimer

This site contains links to other Internet sites, third-party web sites, and e-mails. This does not mean WriteContent has thoroughly reviewed all those sites. WriteContent is providing these links only as a convenience and the inclusion of a link, or referral to any link does not imply endorsement of the linked site nor is this site responsible for any services, goods, or endorsements provided by said linked sites. Further, WriteContent shall not be liable for any damages or costs arising out of or in any way connected to use of any of the services or companies accessed through this site.  Any requests for information, correspondence, complaints, or claims relating to other resources should be directed to the respective site author.

D. Use of Personal Information

WriteContent has the right to use any personal information from the User (e.g., name, telephone number, address) once a work contract (letter contract) delineating the nature and duration of the work has been signed. WriteContent will keep this information strictly confidential unless otherwise stated or agreed to by the User.

E. Remedies

WriteContent and/or the Owner of this site, participating publishers, third party content or service providers, authors, freelancers, writers, dealers, or any supplier are not liable for any indirect, special, incidental, or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise even if advised of the possibility of such damages. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Owner and User. The information and the goods and services provided from this site would not be provided without such limitations. Some state statutes may apply regarding limitations of liability.

F. Limitation of Liability

The sole and entire maximum liability of Owner and any of the providers of information, products, or services, for any reason, and User's sole and exclusive remedy for any cause whatsoever, shall be limited to the amount paid by the User for the information, product, or service.

G. Serverability of the Agreement

In the event one or more of the provisions of this Agreement is deemed to be invalid, illegal, or unenforceable in any respect under applicable law, the validity, legality, and enforceability of the remaining provisions hereof shall not in any way be impaired thereby.

H. Location of Dispute Resolution

This Agreement shall be treated as though it were executed and performed in Portland, Oregon, and shall be governed by and construed in accordance with the laws of the United States of America and of the State of Oregon (without regard to conflict of law principles). The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. All legal proceedings arising out of or in connection with this Agreement shall be brought solely in Portland, Oregon and User expressly submits to the jurisdiction of said courts, and User consents to extra-territorial service of process, provided, however, that at the election of Owner, any disputes arising out of or in connection with this Agreement or the service shall be resolved solely by binding arbitration.

I. Statute of Limitations

Any cause of action by the customer must be instituted within six (6) months after purchase of information, services, or product or be forever waived and barred.

J. Modification

WriteContent may modify the this Agreement at any any time in our sole discretion, by posting a change notice or a new Agreement on our site. Modifications may include, for example, changes in the scope of services, fee schedules, payment procedures, or other business practices.
